Davert & Loe has extensive experience in corporate and general business matters. We are experienced in structuring, negotiating, and closing various transactions, and in advising clients on a variety of legal issues that arise in the regular conduct of their business. We assist our clients with corporate, partnership, and joint-venture formations, dissolutions, and a broad range of related commercial transactions. We are committed to optimizing our clients' interests while taking the necessary preventative steps to avoid future litigation.

Litigation

Our goal in litigation is to provide our clients with the most effective representation at the lowest possible cost. Our depth of experience allows us to offer our clients legal services in a broad range of litigation areas. Over the years, we have learned that one does not need an army of lawyers to be successful in a case. Rather, one only needs an attorney who is sharp and organized, and one who has a strong "game plan." While we are constantly seeking ways to achieve successful results for our clients, we are acutely sensitive to doing so in a cost-effective and professional manner.

In addition to providing top-quality trial representation, our firm is particularly adept at providing individuals and businesses with pre-litigation strategy and advice. We have discovered that our clients seek us out for our judgement in evaluating cases and preventing the need for litigation as well as our litigation abilities. We believe that each client is entitled to a candid assessment of his/her case at the outset, including the relative risks and rewards of litigating. Knowing when and how to settle a case is a skill that is often as valuable as any other litigation talent. We practice in all State and Federal Courts in California.

Real Estate/Environmental

Davert & Loe has broad experience in various real estate matters and related insurance coverage issues. We counsel developers, brokers, architects, builders, contractors, landlords, owners, tenants, and homeowners associations. Services performed include assisting in property acquisition, planning and financing, title matters, construction matters, leasing and purchase arrangements, entitlement and land use issues, government relations, and landlord/tenant disputes. Among our many significant clients, we handle, and have handled, real estate, environmental, and commercial landlord/tenant matters for a Fortune 500 company and similar matters for one of the largest television networks in the world.

We are also equipped to handle a variety of environmental issues related to real property and land use matters including CEQA/NEPA compliance during the development process and matters related to the preparation and certification of EIR/EIS documents. Through our strategic associations with other trusted professionals, experts, and consultants with experience in environmental hazards and clean up issues, we are also able to represent landowners, producers, and other responsible parties in such matters including actions under CERCLA, RCRA and related laws.

Employment

Many of our corporate and business clients rely on us for matters related to employment and labor laws and claims of all types. We advise clients in all aspects of California employment law, federal laws affecting the workplace, and in strategies for avoiding claims from employees. We routinely assist clients with preparing employee handbooks/policies and procedures manuals, establishing “best practices,” and conducting investigations in response to employee complaints and concerns, reviewing training practices, among other issues.

When the threat of employment litigation arises, we are skilled at quickly evaluating a claim and recommending a course of action to the client. While we generally strive to resolve most employment-related claims as quickly and cost-effectively as possible, that is not always possible. We have vigorously and successfully defended scores of employers in litigation at both the state and federal levels in both jury and non-jury trials.

Appeals

Our team of lawyers is experienced in both pursuing and defending appeals in both state and federal courts of appeal. Recently, the firm successfully represented clients in a matter that resulted in a published opinion from the United States Court of Appeals for the Ninth Circuit.

Municipal and Public Agency

The firm has experience working with municipal and public agencies, public officials, and others with interests in the government arena. The firm has handled matters involving state and local administrative agencies, candidates for public office, and public officials in matters ranging from Brown Act and conflict-of-interest matters to land use, entitlement and environmental issues. The firm is licensed in California, Texas and Washington D.C. One firm partner has served as a City Council Member in the Orange County City of Tustin, has served two terms as Mayor of that City, and has served as Chairman of the Board of both the Orange County Fire Auhtority and the Orange County Sanitation District, has served as a Planning Commissioner, and has served on a number of other boards and commissions including as a Board of Appeals member, Community Development Block Grant Allocation Committee member, local business improvement association board of directors member, and as a member of the American Planning Association. The firm has worked closely with city attorneys in other jurisdictions as well as various county counsel and prosecuting agencies.
